Terms of Service

These Terms govern your use of PinClimb (https://pinclimb.com), a software service operated by BlueDots Media LLC, 7533 S Center View Ct Ste N, West Jordan, UT 84084, United States (“we”, “us”). By using the service you agree to these Terms.

1. The service

PinClimb is software that measures how local businesses appear in Google Maps results and in AI assistants, and recommends changes to improve that visibility. Rankings depend on factors outside our control, including the searcher's location and changes by Google and AI providers. We do not guarantee any particular ranking or result.

2. Accounts and acceptable use

• You must provide accurate information and keep your login secure.
• You may only connect or manage business profiles you own or are authorised to manage, and only with the business owner's consent.
• You must not use the service to create or solicit fake reviews, offer incentives for reviews, solicit only positive reviews, or otherwise break Google's policies or consumer-protection laws.
• You must not resell raw data, attempt to overload the service, or bypass usage limits.

3. Plans, billing and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscriptions renew automatically each month or year until cancelled. You can cancel at any time and will not be charged for the next period. Prices may change with at least 30 days' notice; founding-member discounts apply for as long as the subscription stays active.

4. Refunds

Refunds are handled under our Refund Policy.

5. Your data

You keep ownership of your data. We process it as described in our Privacy Policy. Third-party data (such as public Google Maps listings) is provided “as is”.

6. Third-party services

The service relies on third parties such as Google, OpenAI and data providers. PinClimb is not affiliated with or endorsed by them, and their availability or terms may affect features.

7. Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses, including lost profits or profile suspensions by third parties.

8. Termination

We may suspend or terminate accounts that breach these Terms. You may stop using the service at any time.

9. Governing law and disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the service will be heard exclusively in the state or federal courts located in Salt Lake County, Utah, and both parties consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally within 30 days. Nothing in this section removes rights that consumer-protection law in your own country gives you and that cannot be waived by contract.
